These General Terms and Conditions (T&C) apply to all transportation services provided by Senay Sivritepe (Sole Proprietorship), Kirchbichl 83, Top 2, 6352 Ellmau (hereinafter "KitzRide"). By making a booking, the passenger accepts these T&C.
Booking a transportation service via the website, by phone, or by email constitutes a binding offer by the passenger. The contract is only concluded upon booking confirmation by KitzRide.
KitzRide provides passenger transportation services with private hire vehicles under the Austrian Occasional Transport Act. Transportation is carried out with suitable, well-maintained vehicles and professional chauffeurs.
All stated prices are fixed prices and include the statutory value-added tax. Toll and vignette costs are included in the price unless otherwise stated. Payment can be made by credit card, bank transfer, or cash payment to the chauffeur.
Cancellations are free of charge up to 24 hours before the scheduled departure time. For cancellations less than 24 hours before the agreed pickup time, the full fare will be charged. No-shows will also be charged the full fare.
The passenger is obliged to be ready at the agreed pickup location at the agreed time. Waiting times beyond the included period may be charged additionally. Smoking in the vehicles is not permitted. The passenger is liable for contamination or damage to the vehicle caused by them.
KitzRide is only liable for damages in cases of intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. KitzRide is only liable for carried luggage and personal belongings in cases of proven fault.
KitzRide is released from the obligation to perform if performance becomes impossible due to force majeure (e.g., severe weather, road closures, natural disasters, official orders). In such cases, the passenger will be informed immediately and any amounts already paid will be refunded.
The processing of personal data is carried out in accordance with our Privacy Policy, which is available at /datenschutz.
Austrian law shall apply exclusively. The place of jurisdiction for all disputes arising from the contractual relationship is the competent court in Innsbruck, provided the passenger is an entrepreneur. Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
